Unauthorized entry / sham right of entry (§ 14 MRG), sham principal residence

• The case: A right of succession was claimed after the death of the main tenant. However, there was neither a shared household nor an urgent need for housing.

• Illegal or unauthorized secondary residence (sham primary residence): This means that using the apartment for secondary residence purposes is not permitted according to legal regulations. A primary residence requires continuous use throughout the entire year – penalties up to and including the rescission of the purchase agreement are possible.

• Evidence: Proof of the actual center of life through legally admissible determination of living and ownership circumstances, places of work and residence (including abroad), social life in the surrounding area, as well as the actual intensity of use and duration of stay (e.g., mere seasonal presences).
